Professional Responsibilities

Fiduciary Duties

When acting as your real estate agent, we owe you the following fiduciary duties:

  • Loyalty and undivided allegiance

  • Full disclosure of material facts
  • Reasonable care and skill in all transactions
  • Accounting for all funds and property
  • Good faith and fair dealing

Client Responsibilities

As our client, you agree to:

  • Communicate promptly regarding property interests and concerns
  • Respect property showing appointments and arrangements
  • Honor exclusive representation agreements when applicable
  • Pay agreed-upon fees and commissions in a timely manner

Fees and Commissions

Standard Commissions

Our standard commission rates are:

  • Residential sales: 6% of sale price (typically split between buyer and seller agents)
  • Commercial sales: 3-8% depending on property type and complexity
  • Investment property consultation: Hourly rate or percentage of investment value
  • Property management: 8-12% of monthly rental income

Payment Terms

Commissions are typically paid at closing from the sale proceeds. For consultation services, payment may be required upfront or upon completion of services as specified in our agreement.

Property Information and Disclosures

Multiple Listing Service (MLS)

Property information is sourced from MLS databases, public records, and property owners. While we strive for accuracy, we cannot guarantee that all information is current or complete.

Property Condition

We recommend that all buyers conduct thorough inspections of properties before purchase. We are not responsible for property defects or conditions not disclosed by the seller.

Market Analysis

Market analyses and property valuations are based on available data and professional judgment. These are estimates and should not be considered as guarantees of future performance or value.

Limitation of Liability

Our liability is limited to the amount of commission or fees paid for our services. We are not liable for:

  • Property defects or conditions not disclosed by the seller
  • Changes in market conditions or property values
  • Delays in closing or transaction completion
  • Third-party service provider errors or omissions
  • Investment losses or missed opportunities

Termination

Either party may terminate our services with written notice. Termination does not affect:

  • Completed transactions or pending closings
  • Earned commissions or fees
  • Confidentiality obligations
  • Ongoing property management agreements

Dispute Resolution

Mediation

Any disputes arising from our services will first be subject to mediation through a qualified real estate mediation service.

Arbitration

If mediation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Fair Housing

Technology and Website Use
